Protection of privacy and consumer rights under the GDPR

 

This section describes our agency's policy when processing personal data. This policy applies to both automated and manual data processing.

Processing of personal data of visitors and users

Our agency is represented by Nicolas Frings and is located at Drève Richelle 118 – 1410 Waterloo and is registered with the ECB under number 0722948720.

The personal data communicated by the user when making an enquiry via our site or during an event organized by BARNES are processed by our agency in order to respond to the user.

The personal data are only transmitted to the staff handling the requests. These data may be communicated to persons outside our agency when necessary to process the user’s request.

If the user refuses to provide certain essential data, our agency may not be able to process the application.

If you accept these conditions, we will send you the requested information, the list of ads corresponding to the criteria you are looking for and you will also benefit from free information services about our occasional promotions and our agency’s services (newsletter, ….). This information may be personalized.

No data is automatically collected by the site itself. The only data we process is the data you voluntarily provide. Other information that may be collected automatically is only done by statistical tools such as Google Analytics and only relates to your TCP/IP address, the make and latest version of your browser and the web pages accessed, but remains completely anonymous.

We may store an access code and password in a cookie. Other information, such as your search criteria or the language you chose to visit the site, may also be stored in the cookie (A cookie is a small file sent by our server and stored on your computer’s hard drive. It keeps track of the site visited and contains some data related to that visit. Our cookies are mainly used to make the site work (technical session cookies).

We may also process data about you from third parties, such as the media (Immoweb, ImmoVlan, etc.). This data is only transmitted to us following a request via the forms available on their respective sites. Subject to your consent, your e-mail address may be used by the agency for the purposes mentioned above.

The information is for internal use only and will therefore never be resold to other natural or legal persons, whether affiliated with our company or not. However, this data will be transmitted at the request of judicial authorities or police forces without the prior consent of the holder.

We have implemented the necessary security measures to prevent the loss, unlawful use or modification of the information we receive on our site. Data are processed using computers or IT tools and according to procedures and organizational methods closely related to the purposes indicated. Access, in addition to that reserved to the Data Processor, may in some cases be granted to certain categories of persons responsible for the operations of the site (administration, sales, marketing, legal department, system management) or to external parties (such as external technical service providers, courier services, hosting providers, IT companies, communication agencies) designated as Data Processors by the Owner, where applicable. An updated list of these parties can be obtained from the Data Controller at any time.

All our employees/employees who have access to your data have a strict duty of confidentiality.

We are not responsible for the privacy policies of websites hyperlinked to ours.

Data is kept as long as necessary to provide the service requested by the User.

Remarketing

We use a digital advertising service called remarketing, performed by third-party advertising agencies such as Google AdWords and AdRoll. This service anonymously uses the User’s personal data to show the User advertisements for this website based on parameters such as the User’s browsing history on barnes- brabant.com.

If you do not want your personal data to be disclosed to third parties, you can object at the time of collection or at any time thereafter by adjusting your browser preferences. Our agency undertakes to regularly update this charter to take into account any changes in legislation, case law or technical developments. Only the latest version will apply.

Rights of the holder of personal data

The holder of personal data acknowledges being fairly and fully informed about the processing of such data by the brokerage firm. In addition to this right to information, the holder has the following rights:

  • The data subject’s right to access his or her data. This means the right to obtain confirmation from the controller as to whether or not the data are being processed and access to the data.
  • The right to rectification of incorrect information and completion of incomplete data.
  • The right to have one’s data erased (the right to be forgotten) if the data is no longer necessary for the purposes for which it was collected, if the person withdraws consent (and there is no other basis (legal obligation) for the processing), if the person exercises the right to object to the processing, etc.
  • Right to restriction: when the controller no longer needs the data, but they are still needed. When such a restriction, which is in principle temporary, is imposed, the data may only be processed, except for storage purposes, with the data subject’s consent or for specific reasons.
  • Right to portability: the data subject has the right to obtain the data he/she has provided in a structured, commonly used and machine-readable format, and has the right to transfer this data to another controller without the original controller being able to prevent this. The data subject may request that his/her data be transmitted directly from one controller to another.
  • Right to object: data subjects have the right to object to the processing of their data, allowing them to ask the controller to stop processing their data and in any case to object to customer acquisition.
